Planning Documents

  • Wills & Trusts – A will tells a person’s family and the courts how a person’s property is to be distributed upon his or her death.  It is the most straightforward way to ensure your assets are distributed according to your wishes and your family is taken care of after you are gone.  Some people also use trusts in conjunction with a will.
  • Powers of Attorney – A power of attorney is a legal document in which a person designates and authorizes another person to transact business or make certain decisions on his or her behalf. It may also grant another person the authority to make medical decisions and end-of-life decisions.
  • Advance Directives – An advance directive is a legal document that specifies what actions should be taken, if any, for a person’s health if he or she is no longer able to make decisions due to illness or incapacity.
  • A comprehensive plan may include any or all of these documents depending on a client’s particular needs and priorities.

Guardianship

When a relative is not able to make decisions and manage his or her affairs, and does not have a power of attorney designating someone to do these things, a guardianship becomes necessary.  The Court appoints a person to serve as guardian on a temporary or permanent basis, depending on the circumstances of your family.  Contact us for advice and assistance in obtaining a guardianship.

Probate
